A federal appeals court on Oct. 22 rejected energy developer Williams Cos.’ bid to keep a key New Jersey permit in effect for its more-than-$1-billion Northeast Supply Enhancement natural gas pipeline after the firm warned that losing the approval could delay construction and jeopardize the project's late-2027 completion target.
The U.S. Court of Appeals for the Third Circuit in Philadelphia denied Williams unit Transcontinental Gas Pipe Line Co.’s petition for panel and full-court rehearing of a Sept. 8 decision that vacated New Jersey’s water-quality certification under the federal Clean Water Act Section 401.
The denial now requires the New Jersey Dept. of Environmental Protection to return the certification to the agency for further proceedings. It may supplement its explanation, require additional analyses, issue a new or revised certification or reach a different result.
